Missoula, MT (KGVO-AM News) – On July 7th, 2024 at approximately 6:05 pm Missoula Police Department officers were approaching the intersection of Wyoming St and S. Catlin St when they observed a silver Toyota Tacoma approaching the intersection from another direction. The Tacoma made a wide turn onto Catlin and took up most of the opposite lane of traffic.

Officers followed and observed that the Tacoma continued to drive predominantly on the wrong side of the road, apparently only correcting itself due to oncoming traffic. Furthermore, the Tacoma was driven at unusually low speeds of about 15-20 MPH.

Officers initiated a traffic stop as the Tacoma entered the Town and County Lounge parking lot. Upon initial contact, the officer noted that the driver had slurred speech and difficulty formulating complete sentences. The driver, identified as 50-year-old Frederick Gray, was the only individual in the vehicle.

Officers initiated a DUI investigation. Gray, after exiting the vehicle, smelled of alcohol. Gray consented to standardized field sobriety testing and exhibited 16 of 18 indicators of impairment. The preliminary breath test measured Gray’s BAC at .232. Gray then consented to a field sobriety test, which measured his BAC at .246, three times the legal limit.

According to court documents, Gray has a DUI per se conviction dated June 7, 2023, from Missoula Municipal Court. He was originally cited for a DUI-1st. Presumably, the arresting officer did not have full access to Gray’s out-of-state convictions at the time.

Gray has two DUI convictions from Santa Clarita Valley and a “DRIV UN INFL LIQ” conviction from Lahaina. Although this would be a 5th DUI, Gray is not eligible for a 5th Montana DUI conviction because he has not yet been convicted of a 4th DUI in Montana.

Gray was arrested and transported to the Missoula County Detention Center. He is currently charged with felony DUI, fourth offense.
